Career Booster Terms and Conditions

By using our website/platform or CareerBooster services, you herby agree to our Terms and Conditions which govern the use of the assessment and consultation services provided by CareerBooster. By booking, purchasing, or participating in any free or paid service offered by CareerBooster, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Services Provided

CareerBooster specializes in the evaluation and enhancement of professional capabilities. Our services are designed to identify strengths, uncover areas for improvement, and provide strategic guidance. These Services include, but are not limited to:

• Soft Skills Assessments: Evaluations measuring interpersonal skills, communication styles, emotional intelligence, leadership potential, and teamwork capabilities.
• Personal Business Consultation: One-on-one or group sessions where a certified consultant provides feedback on assessment results and delivers strategic career or business advice.
• Feedback and Reporting: The compilation of assessment data into a personal profile or development report.

2. Scope of Service and No Guarantee of Outcome

2.1. Personal Development Only: The Services are intended for personal and professional development and informational purposes only. They are designed to provide insight and guidance.

2.2. No Guaranteed Results: You acknowledge that CareerBooster does not guarantee any specific outcome, including but not limited to job placement, promotion, salary increase, or admission to any educational program. The interpretation of assessment results and the application of consultation advice are solely your responsibility.

2.3. Not a Substitute for Professional Advice: The Services do not constitute psychological, medical, or legal advice. If you require specific advice related to mental health or legal matters, you should seek a licensed professional in that field.

3. Booking, Payment, and Fees

3.1. Fees: The fees for our Services are as set out on our website or in a separate proposal. All fees are non-refundable except as explicitly set forth in this Agreement.

3.2. Payment: Payment is due at the time of booking unless otherwise agreed upon in writing by CareerBooster.

3.3. Taxes: You are responsible for all applicable sales, use, value-added, or other taxes related to your purchase.

4. Cancellation, Rescheduling, and Refund Policy

4.1. Client Cancellations:

• If you need to cancel a scheduled consultation or assessment session, you must provide notice at least 48 hours prior to the scheduled start time to receive a full refund (minus any third-party assessment costs already incurred) or to reschedule without penalty.
• Cancellations made with less than 48 hours' notice, or "no-shows," will be charged the full session fee and are non-refundable.

4.2. Company Cancellations:

CareerBooster reserves the right to cancel or reschedule a session due to consultant illness, emergency, or insufficient enrollment. In such cases, you will be offered a full refund or the option to reschedule at no additional cost.

4.3. Assessment Completion:

Once you have begun a digital assessment or received your results report, the service is deemed rendered and is non-refundable.

5. Assessment Results and Intellectual Property

5.1. Ownership of Materials:

All assessment tools, methodologies, questionnaires, and proprietary materials provided by CareerBooster are the sole and exclusive property of CareerBooster or its licensors.

5.2. License to Use Results:

Upon full payment, CareerBooster grants you a personal, non-exclusive, non-transferable license to use the final assessment report and consultation summary for your personal, non-commercial use.

5.3. Restrictions:

You may not reproduce, distribute, modify, or create derivative works of our proprietary assessment materials or sell your results report to any third party.

6. Confidentiality and Privacy

6.1. Mutual Confidentiality:

Both parties agree to keep confidential all non-public information disclosed during the provision of Services. For the Client, this includes personal data, career history, and assessment answers. For CareerBooster, this includes proprietary methodologies and business practices.

6.2. Limits of Confidentiality:

Confidentiality does not apply to information that:

• Is or becomes publicly available through no fault of the receiving party.
• Is required to be disclosed by law, court order, or governmental authority.
• Pertains to threats to your safety or the safety of others.

6.3. Data Privacy:

Information We Collect

To provide our Services, we collect:

• Identity Data: Name, email, phone number, billing address.
• Assessment Data: Your responses to aptitude and soft skills tests, including behavioral and emotional intelligence metrics.
• Consultation Data: Notes, summaries, and audio/video recordings (recorded only with your explicit consent).
• Technical Data: IP address, browser type, and usage data collected via cookies.

How We Use Your Data

We use your data solely to:

• Administer and score your assessments.
• Conduct personal business consultations and generate feedback reports.
• Communicate with you regarding bookings and results.
• Improve our Services and comply with legal obligations.

Legal Basis for Processing (GDPR)

If you are in the EU/UK, we process your data under the following bases:

• Contract Performance: To deliver the assessment service you purchased.
• Consent: For optional marketing communications or session recordings (you may withdraw consent at any time).
• Legitimate Interests: To improve our assessment tools and maintain records.

Data Sharing & Third Parties

We do not sell your personal data. We share data only with trusted third-party service providers who assist us in operating our business (e.g., payment processors like Stripe, email platforms, secure cloud storage). These providers are contractually bound to protect your data.

Your Privacy Rights (CCPA & GDPR)

Depending on your location, you have the right to:

• Deletion: Request that we erase your personal data ("Right to be Forgotten").

If you access our Services from outside USA, your data may be transferred to and stored in USA. By using our Services, you consent to this transfer.

7. Code of Conduct

During consultations, you agree to:

• Provide truthful and accurate information during assessments.
• Treat our consultants with respect and professionalism.
• Refrain from any harassing, abusive, or inappropriate behavior. CareerBooster reserves the right to terminate a session immediately with no refund if a client is abusive or poses a safety risk.

8. Limitation of Liability

To the maximum extent permitted by law:

8.1. Services Provided "As Is": The Services are provided "AS IS" and "AS AVAILABLE." CareerBooster makes no warranties, either express or implied, regarding the accuracy, reliability, or completeness of the assessment results.

8.2. No Liability for Indirect Damages: In no event shall CareerBooster be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Services; (ii) any decisions made based on the assessment results; or (iii) any conduct or content of any third party.

8.3. Cap on Liability: CareerBooster's total liability to you for all claims arising out of or relating to this Agreement shall not exceed the amount paid by you to CareerBooster for the specific Service giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless CareerBooster, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your violation of these Terms or your misuse of the assessment results.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of laws principles. Any legal action or proceeding arising under this Agreement will be brought exclusively in the courts located in Florida.

11. Modifications to Terms

CareerBooster reserves the right to modify these Terms and Conditions at any time. If we make material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on our website prior to the change becoming effective. Your continued use of the Services after such notification constitutes your acceptance of the revised terms.
